Register at www.fmbodytransformation.com. Registration begins March 24, 2018 (“Registration/Start Date”). You may start your 12-week transformation any time on or after the Registration Date, as long as you have completed Registration on www.fmbodytransformation.com, and have paid the registration fee. You may also submit your “Before” pictures thereafter on the date you choose to start your transformation. *Before & After picture criteria is set out hereunder.* You may start your Transformation any time after March 24, 2018 ; however, you will only have 12 weeks from the day you start to the day you finish to complete your transformation. All “After” pictures must have their newspaper display the date your 12-week period ends (End Date). You are responsible for calculating your 12-week period from your Start Date to your End Date. Contest will be closed on July 1, 2018. Please be advised that the last date to receive the time benefit of the full 12-weeks, you will need to register, pay the registration fee and submit your “Before” pictures by April 8, 2018. If you start any time after April 8, you will only have that amount of time to complete your transformation. For instance, if your “Before” pictures display a date 10 weeks before July 1, 2018, you will only have that 10 weeks to complete your transformation and to submit your “After” pictures.

How to Enter
Register at www.fmbodytransformation.com. Registration begins March 24, 2018. To enter the Contest, you are required to register at www.fmbodytransformation.com. Contestant must complete all information requested on the website, including submission of required “Before” and “After” photos. Any communication regarding the Contest will be sent to the e-mail address on file. It is Contestant’s responsibility to notify the FM Body Transformation (FMBT) of a change of e-mail address at team@fmbodytransformation.com. All materials submitted become the property of the FMBT and its agents and will not be returned. Contestants must complete the entry form themselves. False, deceptive or incomplete entries provided by Contestant shall render the entry ineligible. Use of any illegal or banned substances to achieve results is prohibited. Contestants may be required to test and/or sign an affidavit verifying that their transformation was achieved without the use of illegal substances. FMBT reserves the right to disqualify any Contestant for any reason that would deem a disqualification by the standards of the FMBT.
IMPORTANT NOTICE TO CONTESTANTS: CONTESTANTS ARE RESPONSIBLE FOR DETERMINING THE CORRESPONDING TIME ZONE AND THEIR 12-WEEK COMPLETION DATE IN THEIR RESPECTIVE JURISDICTION IN US/CANADA CENTRAL STANDARD TIME (CST).
Photo Submission
To enter, Contestants must submit three (3) “Before” photographs: one (1) full front body view, one (1) full back body view, once (1) full side body view. Please be advised that half pictures or pictures without the face included will rule contestant ineligible. All pictures must contain a newspaper. The date must be legible to the naked eye in the photographs. Contestant must be clothed in a bathing suit (male or female) or similar clothing with similar body parts visible if they were wearing a bathing suit. Contestant must also submit three (3) “After” photographs with the same requirements as the “Before” photographs and must be taken no later than 11:59 pm CST on the date 12 weeks after the date displayed on their “Before” pictures. Any photos that appear to be someone else or have been professionally produced or those that have been altered or enhanced will be rejected. Submission of Images and entry in the Contest constitutes Contestant’s consent to use said submitted Images on FMBTs website and associated or affiliated websites and on its social media sites, and may be used for print or on other forms of marketing in perpetuity without compensation. Contestant represents and warrants that he or she has all rights to the Images and all materials submitted in connection with the Contest. Contestant grants a perpetual, royalty-free, non-exclusive license of the Images and any materials submitted in connection with the Contest to FMBT. FMBT and its affiliates will decide, in their sole discretion, whether or not to accept Contestant’s photographs or other materials. FMBT will not be responsible for any financial reimbursement to the original copyright holder for the right to publish the Images as provided herein. FMBT will not be held under any obligation to publish a photo credit to the original copyright holder for the publication of an Image. Contestant agrees to hold FMBT and its affiliates harmless, defend and indemnify FMBT from any and all liabilities, loss, claims, or causes of action, including reasonable attorneys’ fees and expenses that may be incurred by FMBT, arising out of or relating to Contestant’s Images or any violation of the Rules.
Eligibility
Eligibility for The FM Body Transformation (“FMBT”) will be open to anyone who is 18 years of age or older - Worldwide. Contestants may not be members of any guild, union or other organization that may prohibit them from participating in this Contest and that would restrict, require due payment or otherwise have the right to oppose such Contestant’s participation in this Contest. Except as otherwise permitted herein, only one entry per person will be accepted. If a Contestant submits multiple entries, the last will be accepted and the others will be discarded. In order to be eligible, Contestant must follow these Rules. Failure to comply with these Rules will result in ineligibility of Contestant. This Contest is void where prohibited or restricted by law. *All prize values are denoted in United States currency (USD).
Winner Selection
One (1) Contestant will be selected as the 1st Place winner by; FMBTs’ judges and/or affiliates applying the following criteria, in their sole discretion: Visual Physical improvement made to Contestant’s body as evidenced by the “Before” and “After” photos as submitted. Winner will be chosen on or about July 15, 2018, and will be notified by email and must respond within 48 hours to make prize arrangements. The judges will consist of FMBTs’ agents, affiliates and agents qualified to apply the judging criteria in FMBT’s sole discretions. All decisions of FMBT are final. There will be one (1) winner for each prize listed in this document.
Additional Requirements
All Winners agree to sign any documentation requested by FMBT, including, without limitation, an Affidavit of Eligibility/Release of Liability/Prize Acceptance Form when selected and upon presentation of said forms by FMBT. If any document is returned to FMBT as undeliverable or if FMBT does not receive a response from any Winner within two (2) business days of attempted notification, such Winner may be disqualified and the prize will be awarded to an alternate winner. Should the Winner be unable or unwilling to fulfill the obligations outlined in the Rules, a substitute winner will be named.

Language
The official version of these Official Rules is the English language version. In the event of contradictions or discrepancies between different language versions of these Official Rules, the English language version takes precedent. Entrants must submit all materials and information in English. FMBT is not responsible for translation of any submissions or information provided in another language. Failure to submit required information in English may result in disqualification.
Personal Information
Any personal information that Contestants and Winners submit in connection with the Contest will be collected and used by FMBT and their authorized agents to administer the Contest and award the prizes. Contestant’s personal information may also be used to send additional information about FMBT, their affiliates and licensees, in accordance with applicable law. Except as set forth herein, Contestant’s personal information will not be used for any other purpose and will not be shared with anyone else, unless required by law.
Release
In consideration of the acceptance of Contestant’s entry in the Contest and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Contestant hereby takes action for themselves, their executors, administrators, agents, representatives, spouse, children, heirs, next of kin, successors, and assigns, and acknowledges and agrees as follows: (a) to be bound by the Rules; (b) that participation in the Contest is voluntary; (c) Contestant is not a minor; (d) Contestant is of sound mind and body and have not been advised otherwise by qualified medical person; (e) Contestant possesses all rights and faculties necessary to execute, deliver and perform this agreement; (f) certifies that Contestant meet all eligibility requirements as set forth in the Rules, which I have read, understand, and agree to; (g) certifies that all photographs Contestant submits for the Contest will depict only Contestant, will not be altered in any manner whatsoever, will be owned by Contestant and not require the consent of any other third party rights holder; (h) Contestant is fully aware and assume the risk of illness, accidents, injury, death, personal injury, bodily harm, emotional stress, psychological harm, property damage and all dangers potentially arising from or in connection with participation in the Contest. Further, Contestant irrevocably grants to FMBT the right to edit, modify and/or publish and copyright the Images. FMBT does not make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of any prize, including, without limitation, quality, merchantability and fitness for a particular purpose.
Disclaimer of Liability
FMBT is not responsible for any incorrect or inaccurate entry information, human error, technical malfunction, failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, access providers, or software, including any injury or damage to Contestant’s or any other person’s computer relating to or resulting from participation in this Contest; inability to access the entry website or any pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of entries; entry submissions that are processed late or incorrectly or are incomplete, garbled, or lost due to computer or electronic malfunction or traffic congestion on the Internet or any website. Proof of entering information or website is not considered proof of delivery or receipt. All dates set forth in these Rules are approximate. NOTWITHSTANDING ANY OTHER PROVISION OF THIS AGREEMENT TO THE CONTRARY, FMBT SHALL NOT BE LIABLE TO ENTRANT OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, PUNITIVE, EXEMPLARY OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FOR LOST PROFITS), EVEN IF FMBT HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH DAMAGES. The FMBT is further released from liability of injury or illness or the like that may result from a Contestant participating in this Contest (see “Warning” below). FMBT reserves the right to terminate, suspend, withdraw or amend the Contest for any reason.
Health Warning
You (the Contestant) are responsible for seeing your physician or health care provider before beginning any exercise program or changing your physical activity patterns, you should always consult with your doctor or physician, particularly if you have been inactive, are very overweight, or have or suspect any sort of medical condition that might be worsened by exercise.
Legal Venue
The FMBT is legally organized in the State of North Dakota. Any and all rules and terms in these rules and regulations are determined by the State of North Dakota. Any dispute related to this Contest shall be decided in accordance with the laws of the State of North Dakota. By entering this Contest, Contestant(s) agree that if any dispute arises, the issue may only be resolved in arbitration in Fargo, North Dakota.
