This Privacy Policy provides information about our data handling practices that are specific to The FM Body Transformation.
This is the Privacy Policy for The FM Body Transformation website and The FM Body Transformation (hereinafter referred to as, “FMBT”), which is provided by Magnum Performance & Distribution, Inc. FMBT’s mission is to help you achieve the healthy, fit body and to present the opportunity to communicate with others transforming their body by taking part in the FMBT. FMBT gives you the opportunity to upload personal information to our website and send us information, including health information, by completing your Information Profile.
1. How does FMBodyTransformation.com collect information about you?
A. FMBT’s website collects information from the FMBT’s website in two ways.
1. De-identified information
When you access the FMBT’s website and related websites, we automatically gather certain non-personally identifiable information about your computer and your use of the FMBT’s websites using various technologies, such as cookies and web beacons. Cookies are small text files that are transferred to your computer’s hard disk by a website. Web beacons (also referred to as GIF files, pixels or Internet tags) help recognize a unique cookie on your browser. Your Internet browser automatically transmits to FMBT’s websites some of this unidentifiable information, such as the URL of the website you just visited and the browser version your computer is operating. 2. Personal information
When you register on the FMBT’s website, we will ask you to provide certain personal information that identifies you (such as your name, mailing address, email address, date of birth and gender). As you set up your profile on the FMBT’s website, we will ask you to create a Username and Password. The Username you create does not have to relate to your name or other information that could identify you.
Once you have registered on the FMBT’s website, you will be able to participate in FMBT’s website forums comprised of other FMBT members. When posting messages in the FMBT’s website blog/forum, other users will be able to identify you only by your Username.
B. The FM Body Transformation
FMBT members are eligible to apply for The FM Body Transformation (see Official Contest Rules and Regulations of The FM Body Transformation). The FM Body Transformation applicants are asked to provide us with the personal information described above and additional information relative to the FMBT, and three (3) before photographs (font view, side view, and back view) that can identify you and your start date and information about which Magnum Nutraceuticals products you use. Applicants are required to hold that days newspaper in their picture to ensure FMBT is aware of their exact start date.
You may also choose to provide us with additional information, such as your telephone number, occupation, height and health information (such as blood pressure, cholesterol and body fat %) if you wish.
2. Where do we keep the information that we store?
A. FMBT’s website
Personal information collected when you register on the FMBT’s website is retained on servers in the U.S. Information that you choose to share with other FMBT’s members in the FMBT’s website blog/forum may be transferred and made available in other countries outside the U.S where those FMBT’s members are located.
B. The FM Body Transformation
Information you send to us by post as part of the FMBT is retained in the U.S. at the following address: Magnum Performance & Distribution, Inc., d/b/a The FM Body Transformation, 374 5th Street North, #301, Fargo, North Dakota 58102, United States of America.
C. International Transfer of Your Information
The U.S. may not offer the same level of privacy and confidentiality protection that you are used to in the country where you live. Where FMBT is responsible for storing the information you provide to us, then FMBT will handle such information in accordance with FMBT’s policies and applicable law. FMBT shall not be responsible for protecting the privacy of the information you choose to transmit in the FMBT’s website blog/forum to other FMBT members who may be located outside the U.S. and over whom we have no control.
Please note that no method of transmitting or storing electronic data is completely secure, and we cannot guarantee that such information will never be accessed, used, or released in a manner that is inconsistent with this policy.
3. How do we use data?
A. FMBT’s website
If you consented to our sending you communications regarding products and services, then we will send you information about such products and services by post, email, SMS or telephone. FMBT uses other information collected from the FMBT’s website in two ways.
1. De-identified Information
The unidentifiable information that we automatically collect from you is used to make your use of the FMBT’s website easier by allowing FMBT to provide a better service, customize the FMBT’s website based on consumer preferences, compile statistics, analyze trends, and otherwise administer and improve the FMBT’s website.
2. Personal Information
We may use and consolidate the personal information that we collect about you through the FMBT’s website to respond to your questions and to provide you with efficient customer service. After you have entered personal information into the FMBT’s website, FMBT may use certain identifying technologies to allow the FMBT’s website and related websites to “remember” your personal preferences, such as sections the website(s) that you visit frequently and, if you choose, your Username.
B. The FM Body Transformation
FMBT uses the personal information and any health information that you submit on the FMBT’s website as follows:

Personal information sent to us using the FMBT’s website will be used to judge your entry into the Transformation in accordance with The FM Body Transformation’s Official Rules and Regulations. FMBT may also use the personal information you on FMBT’s website for promotional and advertising purposes to promote Magnum Nutraceuticals products, its businesses, and FMBT worldwide and in any media and manner whatsoever.
2. Health Information
Any health information (such as blood pressure, cholesterol and body fat %) that you choose to provide to us on The FM Body Transformation’s website will be handled in the same way that we handle your personal information as described above. 4. How long will FMBT store my personal information and health information
In general, FMBT will only store your personal information and health information for as long as it is needed to fulfill the purposes for which it was collected, subject to applicable data retention periods imposed upon FMBT by applicable law.
5. How do we share personal information that we collect about you?
Although we may share personal information that we collect about you through FMBT’s website, we generally do not share this information with third parties, except as described in this policy and The FM Body Transformation’s Official Rules and Regulations.
We also may share this information with outside vendors, such as vendors that help us update and maintain the FMBT’s website and judge the FMBT, but we will instruct those vendors not to use any information that we share with them in a manner that is inconsistent with this policy.
We will not share information that we collect through FMBT’s website with any third parties for those third parties’ direct marketing purposes.
6. What rights and choices do I have over my personal information?
You also can email us at webmaster@fmbodytransformation.com with the words “Deletion Request” in the subject line or write to us at the address provided in this policy. Any email you send should indicate the email address that you used to register with the FMBT, the email address to which your request relates (if different), and a statement that you wish to opt out of marketing communications relating to the FMBT’s. (Please note that, even if you opt out, we still may send you certain administrative communications, such as legal and account notices.)
You may request to remove, amend or correct your personal information by email to the same address or by writing to us at the address provided in this policy.

7. Will these privacy practices change?
We occasionally may change these privacy practices, so you should review this Supplemental Privacy Policy, periodically. If we make material changes to our privacy practices that are specific to FMBT, we will notify you of our new practices by email. For generally applicable material changes, we will notify you of our new practices by posting an update in our policy. In each case, we will indicate the date on which the policy was most recently changed so that you can easily determine if there are any updates.
